CHARTER AGREEMENTS

Charter fee and payment

The full charter fee must be paid within 45 days of the commencement of the charter.  If you have made a deposit, then the entire amount due will be charged to the credit card we have on file for you unless you notify us otherwise.

Cancellation or termination by you

Excursion charter reservations must be cancelled more than 48 hours from the departure time and date of the original reservation or the charter fee will be forfeited by the charterer.  If Blue Lagoon Charters is able to re-book the charter to another party, we will refund the fee minus twenty-five percent(25%) for administrative costs.

Liability

Blue Lagoon shall, at its own cost and expense, keep the Vessel fully insured against fire, collision, perils of the sea, theft and other risks normally insured
against under standard marine coverage, and maintain on it’s own behalf (and on behalf of the Charterer) protection and indemnity insurance with respect to
third parties, for death and injuries to persons and property, BUT SUCH COVERAGE SHALL NOT EXTEND TO ANY PERSONAL INJURY, BODILY INJURY,
DEATH OR PROPERTY DAMAGE TO THE CHARTERER, PASSENGERS, INSTRUCTOR, PAID MASTER OR PAID CREW ON THE VESSEL. IN THE
EVENT THAT ANY ACT OR OMISSION OF THE CHARTERER NULLIFIES ANY INSURANCE PROVIDED HEREIN, THE CHARTERER SHALL PAY TO
BLUE LAGOON ALL LOSSES AND INDEMNIFY BLUE LAGOON AGAINST ALL CLAIMS AND DEMANDS WHICH WOULD OTHERWISE HAVE BEEN
COVERED BY SUCH INSURANCE. BLUE LAGOON SHALL NOT BE RESPONSIBLE FOR ANY PERSONAL INJURY, DEATH OR PROPERTY DAMAGE
TO THE CHARTERER, PASSENGERS, PAID CREW, OR PAID MASTER ON THE VESSEL HOWSOEVER CAUSED.

Loss of Use

If we experience a mechanical or systems problem which prevents us from delivering the vessel to you at the promised time, we will refund your money.
